Only a REALTOR® Principal (broker) can file an arbitration request, not an agent. This is because by state law, all commissions are the commissions of the broker. Only a REALTOR® Principal (broker) can accept or pay commission on a real estate transaction.
Arbitration cannot be filed against your broker and cannot be used to enforce your independent contractor agreement.
No request will be reviewed without receipt of the required $250 deposit.
Agreements to arbitrate are irrevocable except as provided under state law.
If you would like to try mediation first, contact ethics@hrra.com. There is a $250 deposit for a mediation session. If the dispute can be resolved in one session the $250 deposit is returned to the broker. Each session thereafter will be invoiced at $250 per hour. If the issue cannot be resolved through mediation, the $250 deposit will be held as the arbitration hearing deposit. The prevailing party's deposit will be returned within 30 days of the hearing, this allows for the 20 day appeals process.
